Witness Protection

It is illegal to threaten or intimidate a witness.

Special measures are in place at most courts for vulnerable or intimidated witnesses.

These include:

  • The option for witnesses to be recorded giving evidence and being questioned on video instead of going to the trial.
  • Sitting in a different room away from the courtroom, and giving evidence via a live TV link.
  • Placing a screen around the witness box, so the defendant and witness cannot see each other.
  • The witness being questioned by the opposing party before the trial.
  • The witness being positioned so they can only see the judge, jury and the lawyers.
  • The judge and lawyers not wearing their formal black robes and wigs as they normally would in Crown Court, so that you feel more comfortable.
  • The public gallery being cleared except for one member of press. 
 
There are also additional special measures in place for people under the age of 17 and vulnerable adults (for example, those who have a mental illness, physical disability, or limited understanding).

For example, witnesses may be able to use a communication aid to help give their evidence, or an approved intermediary may be on hand.

Ultimately, the court will decide if an individual qualifies for special measures at the trial. In making this decision, they will consult with you, South Wales Police, the Crown Prosecution Service, or the defence lawyer.

If you are due to make a police statement or give evidence at court, and feel intimidated by somebody, report it to the officer dealing with your case as soon as soon possible.
